TO WHOM IT MAY CONCERN: The application described below has been submitted for an Aquatic Resource Alteration Permit under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, federal permits may be required from the U. S. Army Corps of Engineers and the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act, respectively. Section 401 of the Clean Water Act requires that an applicant obtain a water quality certification from the state when a federal permit is required. This notice may cover applications subject to §401.

No decision has been made whether to issue or deny this application. The purpose of this notice is to inform interested parties of this permit application and to ask for comments and information necessary to determine possible impacts to water quality. Persons wishing to comment on the proposal are invited to submit written comments to the Division. Written comments must be received within thirty days of the date that this notice is posted. Comments will become part of the record and will be considered in the final decision. If it is hard for you to read, speak, or understand English, TDEC may be able to provide translation or interpretation services free of charge. PROJECT DESCRIPTION / PURPOSE

The proposed work includes construction of 340 feet of additional rip rap revetment at a site on which previous bank stabilization has occurred. In 2016, approximately 150 feet of revetment was installed, along with along with five jetties on a length of stream bank totaling 490 feet. According to the application, a large storm in this area in April 2017 caused excessive scour in the bed of the stream. The bed scour destabilized the newly constructed slopes between the existing rock riprap jetties. This proposed project is to repair the eroded banks between the jetties with new rock rip rap revetment in the eroded areas that will total 490 feet of revetment.

WATERSHED / WATERBODY DESCRIPTION

This segment of Lick Creek is Exceptional Tennessee Waters from the Duck River to the confluence of the Barren Fork River. The basis for inclusion is the presence of the state threatened Coppercheek Darter. Lick Creek is located in the Lower Duck River watershed. The Lower Duck River Watershed is located in Middle Tennessee and includes parts of Dickson, Giles, Hickman, Humphreys, Lawrence, Lewis, Maury, Perry and Williamson counties. It drains approximately 1,548 square miles and empties to the Tennessee Western Valley Watershed. DETERMINATIONS

In accordance with the Tennessee Anti-degradation Statement (Rule 0400-40-03-.06), the Division has made a preliminary determination that the proposed activities will result in no more than de minimis degradation to water quality or no appreciable permanent loss of resource value.
