1. The State was previously granted permission to Publish on the Mother, Kendall Bishop, the publication was unable to run the required four consecutive weeks for today’s hearing. 

2.The State has made numerous attempts to personally serve the Mother, Kendall Bishop who currently resides in Duck River, Tennessee-Hickman County.  Therefore the Court finds service by publication is reasonable and necessary under all of the circumstances and further that the place of publication shall be in or about Duck River, Tennessee-Hickman County in a paper of general circulation.

3.Therefore the whereabouts of the Respondent, Ms. Kendall Bishop cannot be ascertained by diligent search; therefore, the ordinary process of law cannot be served upon Ms. Kendall Bishop.  It is therefore, ORDERED that Ms. Kendall Bishop, be served by publication of the following notice for four (4) consecutive weeks in a paper of general circulation in or about Duck River, Tennessee-Hickman County, as Ordered herein.

It is further ORDERED that if Ms. Kendall Bishop does not enter an appearance or otherwise answer the State’s Petition, or any other pending petitions, that further personal service or service by further publication shall be dispensed with and service of any future notices, motions, orders or other legal documents in this matter may be made upon the Respondents by filing same with the Juvenile Court Clerk of Rutherford County, Tennessee.

It appears ordinary process of law cannot be served upon you because your whereabouts are unknown or you are avoiding service of process.  You are hereby ORDERED to appear in the Juvenile Court of Rutherford County, 1710 South Church Street, Murfreesboro, Tennessee, on the 14th day of December, 2017, at 1:00 p.m. to personally answer the Petition for Dependency and Neglect.  Failing to appear for the hearing on this date and time, without good cause, pursuant to the Rules of Juvenile Procedure and the Rules of Civil Procedure will result in the loss of your right to contest the Petition for Dependency and Neglect as to the Child, Brison Woodard.  You may view and obtain a copy of the State’s Petition, and any other subsequently legal filings at the Juvenile Court Clerk’s Office, Rutherford County, Tennessee.

BROWNFIELD REDEVELOPMENT OF 400 RIVERS ROAD, CENTERVILLE, HICKMAN COUNTY, TENNESSEE (THE “SITE”)

NOTICE OF AN APPROVED ADMINISTRATIVE SETTLEMENT PURSUANT

TO 42 U.S.C. § 9613(f) WITH RESPECT TO THE ABOVE-REFERENCED SITE

The Tennessee Department of Environment and Conservation (“TDEC”) has accepted the Site, an approximately 22.57-acre property, into the Brownfield Program to facilitate redevelopment.  This is being done pursuant to the state’s brownfield law, Tenn. Code Ann. § 68-212-224.  A Brownfield Agreement between Community First Bank & Trust, a Tennessee state chartered bank (“Voluntary Party”) and TDEC includes liability protections for the Voluntary Party and its successors, including protection against third-party contribution claims regarding matters addressed in the Brownfield Agreement.  This notice serves the dual purpose of notice of the terms of the Voluntary Agreement to the general public and to third parties that hold contribution claims under 42 U.S.C. § 9601 et seq.

The Site is a partially developed parcel with a 128,995 square feet industrial building, a 13,220 square feet metal shop building and other site improvements. The Brownfield Agreement addresses historical on-site operations including manufacturing plastic signs, painting operations, manufacturing steel scaffolding equipment, general shop/machining, electronics and plastics recycling, and use of underground storage tanks, as well as, potential impacts from metals, volatile organic compounds and petroleum related constituents. 

The Site has been the subject of environmental investigations, the results of which have been reviewed by TDEC- Division of Remediation (DoR).  These investigations concluded that the Site has been impacted by real or perceived hazardous substances, solid wastes or other pollutants determined to be present in this Site relating to the past operations at the site and/or at neighboring properties.  Due to the presence of these constituents, a Notice of Land Use Restrictions will be placed on the Site to limit certain future activities there.  These and other measures required by DoR under the Agreement for the Site will ensure protection of human health and the environment.

The Voluntary Party intends to divest the Site for use as an industrial/commercial facility.  The public may contact Mr. Chris Seifert at the Tennessee Department of Environment and Conservation, Division of Remediation, 711 R. S. Gass Boulevard, Nashville, Tennessee 37243 or by phone at (615) 687-7065 to obtain a copy of the Brownfield Voluntary Agreement. The DoR is accepting written comments from the general public on the Brownfield Voluntary Agreement for thirty (30) days after the date of publication of this notice, and these comments should be mailed to Mr. Seifert at the above address.
