NOTICE OF SALE OF REAL ESTATE

WHEREAS, by deed of trust dated June 28, 2011, of record in Book 28 at page 295 in the Register’s Office of Hickman County, Tennessee (the “Deed of Trust”), Wayne Jones (also known as Gerald Wayne Jones) (the “Grantor”) conveyed the hereinafter-described real estate (the “Property”) to Barney B. Regen, Trustee (the “Trustee”), to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the Grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the “Note”); and

WHEREAS, default has occurred in the payment of the Note and other provisions of the Deed of Trust have been violated, and First Federal Bank, the owner and holder of the Note, has declared the entire indebtedness due and payable, and has directed the Trustee to foreclose the Deed of Trust in accordance with the terms thereof;

THE PUBLIC IS HEREBY NOTIFIED that the Trustee will sell the Property at public auction to the highest and best bidder for cash at the south door of the courthouse in Centerville, Tennessee, at the hour of 10:30 a.m. prevailing central time on Friday, March 13, 2015, in bar of the Grantor’s right and equity of redemption, and subject, inter alia, to all liens, encumbrances, and other defects in title having priority or preference over the Deed of Trust; to the rights of tenants in possession (if any); and to all applicable and enforceable laws of governmental authorities having jurisdiction of the Property, whether or not such matters are disclosed by the public records of the county wherein the Property is located.

The Property is described in the Deed of Trust as follows:

Lying and being situated in the Ninth Civil District of Hickman County, Tennessee, being shown on the Tax Books as Map 105, Parcel 016.07, and more particularly bounded and described as follows:

Beginning on a found 1/2 iron pin in the East margin of Trace Creek Road 25.00 feet from centerline, Joseph K. Orman’s Southwest corner (Deed Book 119, page 847); thence with Orman’s South boundary line South 79 degrees 57 minutes 34 seconds East for 1,037.18 feet to a found 1/2 inch iron pin; thence South 78 degrees 26 minutes 47 seconds East for 575.64 feet to a 10-inch maple in William R. Rollins’ West boundary line (Deed Book 117, page 533); thence with a blazed and painted line and Rollins, South 44 degrees 11 minutes 32 seconds West for 377.67 feet to a 10-inch mountain oak; thence with a severance line, North 63 degrees 38 minutes 15 seconds West for 457.09 feet to a set 1/2 inch iron pin; thence with said severance line North 77 degrees 16 minutes 54 seconds West for 827.55 feet to set 1/2 inch iron pin in the East margin of said Trace Creek Road; thence with the East margin of said road North 30 degrees 03 minutes 57 seconds West 210.00 feet to the point of beginning.

The above-described parcel contains 7.0522 absolute acres by a Legal Category II Survey made by Jay T. Moore, Tennessee Registered Land Surveyor No. 791 of Decaturville, Tennessee, on the 1st day of March 1998, the bearings were taken from a survey made by James Jenkins, Tennessee Registered Land Surveyor No. 215, on the 3rd day of September 1997, the measurements and angles were made with a Topcon GTS 203 Total Station, and the telephone number of surveyor is 901-852-4545.

Restrictions: The above property is subject to the following restrictions:

No single-wide mobile homes allowed.

Double-wide mobile homes allowed only if they meet the following specifications:

Minimum size of 1,250 square feet.

Must have solid footing on outside perimeter.

Must be anchored and tied down into concrete.

Tongue must be taken off.

Outside of mobile home must be bricked four bricks high above the bottom of the base of the siding of the mobile home.

Must have front porch, no smaller than 6 feet by 10 feet.

All the above must be completed before occupation.

No junk cars to be located on the premises.

Being the same property conveyed to Wayne Jones and Terry Troop by deed from Donald W. Forrester and wife, Lisa R. Forrester, dated and recorded July 7, 2003, at 1:06 p.m. in Book 11, page 5390; Terri (Terry) Troop conveyed her interest in the property to Wayne Jones by quitclaim deed dated and recorded September 29, 2006, at 11:05 a.m. in Book 19, page 3284, both recorded in the Register’s Office of Hickman County, Tennessee.

The street address of the Property does not exist, is not in common use, or is not available.

The Property is believed to be identified as Map 105-00-016.07 on the Hickman County tax map.

The Property is believed to be unimproved.

The right is reserved to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the sale above, and thereafter to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the first adjourned sale; and the right is reserved to repeat this process from time to time until the Property is sold by the Trustee, or until the expiration of one (1) year following the originally scheduled date of sale.

The right is reserved to cancel the sale of the Property at the request of the secured creditor, and to re-advertise the Property for sale at a later date, without diminishing, impairing, or otherwise affecting the priority of the Deed of Trust as a lien on the Property.

If the highest bidder does not pay the bid price within twenty-four (24) hours of the sale, the right is reserved to sell the Property to the next highest bidder who is ready, willing, and able to purchase the Property for cash.

The record owner of the property is Wayne Jones.

There is no record holder of any mortgage, deed of trust, or other lien which will be extinguished or adversely affected by the sale of the Property, and which mortgage, deed of trust, or lien, or notice or evidence thereof, was recorded in the public records of Hickman County, Tennessee, more than ten (10) days prior to the first advertisement or notice of sale.

The Trustee is unaware of any other party whose rights will be adversely affected by the sale of the Property pursuant to this notice.
