NOTICE OF SALE OF REAL ESTATE

WHEREAS, by deed of trust dated September 18, 2009, of record in Book 25 at page 5623 in the Register's Office of Hickman County, Tennessee (the "Deed of Trust"), Amy L. Dunn-Rogers and husband, Jason M. Rogers (collectively, the “Grantor”), conveyed the hereinafter-described real estate (the "Property") to Barney B. Regen, Trustee (the “Trustee”), to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the Grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the "Note"); and

WHEREAS, default has occurred in the payment of the Note and other provisions of the Deed of Trust have been violated, and First Federal Bank, the owner and holder of the Note, has declared the entire indebtedness due and payable, and has directed the Trustee to foreclose the Deed of Trust in accordance with the terms thereof;

Being the same property conveyed to Amy L. Dunn-Rogers by deed from Jeanette Marie Starkey and husband, Scott Starkey, dated February 11, 2008, and recorded February 12, 2008, at 12:30 p.m. in Book 22 at page 4810 in the Register’s Office of Hickman County, Tennessee.

The street address of the Property is believed to be 3622 Indian Hill Road, Nunnelly, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and the street address, the legal description will control.

The Property is believed to be Lot 36 in the Cherokee Estate Subdivision, as shown on plat of record in Plat Book 3, page 37, Register’s Office of Hickman County, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and said lot number, the legal description will control.

The Property is believed to be identified as Map 059E/059L-A-009.00 on the Hickman County tax map.

The Property is believed to be improved.

The right is reserved to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the sale above, and thereafter to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the first adjourned sale; and the right is reserved to repeat this process from time to time until the Property is sold by the Trustee, or until the expiration of one (1) year following the originally scheduled date of sale, whichever occurs first.

TO WHOM IT MAY CONCERN: The application described below has been submitted for an Aquatic Resource Alteration Permit under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, federal permits may be required from the U. S. Army Corps of Engineers and the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act, respectively. Section 401 of the Clean Water Act requires that an applicant obtain a water quality certification from the state when a federal permit is required. This notice may cover applications subject to §401.

No decision has been made whether to issue or deny this permit. The purpose of this notice is to inform interested parties of this permit application and to ask for comments and information necessary to determine possible impacts to water quality. Persons wishing to comment on the proposal are invited to submit written comments to the department. Written comments must be received within thirty days of the date that this notice is posted. Comments will become part of the record and will be considered in the final decision. The applicant's name and permit number should be referenced.

The permit application, supporting documentation including detailed plans and maps, and related comments are available for review and/or copying at the department's natural resources section.

Interested persons may also request in writing that the department hold a public hearing on this application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. WATERSHED /WATERBODY DESCRIPTION: The proposed project is located within the Lower Duck River Watershed. The Lower Duck River Watershed encompasses nine counties within Tennessee and drains approximately 1,548 square miles. The Lower Duck River is located in the Western Highland Rim Ecoregion (71f). Stream 1 - Stream 1 was identified as the Duck River. The applicant proposes to place rock riprap equal to bankfull height along the right descending bank with a 35-foot wide native riparian forested buffer to be established and maintained above the rip rap revetment. The applicant proposes to install one rock jetty at the downstream end of the riprap revetment. Bank height along the proposed reach varies from 14 to 18 feet. The applicant proposes to extend the 35-foot wide riparian buffer for an additional 1,300 linear feet immediately downstream of the proposed project reach.

PROJECT DESCRIPTION: The applicant is proposing to use rock riprap along the lower slopes and native vegetation along the upper slopes to stabilize 700 linear feet along the right descending streambank of the Duck River in Hickman County. The applicant purposes to construct a forested riparian buffer totaling 2,000 linear feet adjacent to and along the proposed project site. In accordance with the Tennessee Antidegradation Statement (Rule 0400-40-03-.06), the division has determined that the proposed activities will not result in greater than de minimis degradation to water quality.
