NOTICE OF SALE OF REAL ESTATE

WHEREAS, by deed of trust dated July 8, 2009, of record in Book 25 at page 3038 in the Register’s Office of Hickman County, Tennessee (the “Deed of Trust”), Van K. Younger (also known as V. Kurt Younger) and wife, Beverly J. Younger (collectively, the “Grantor”), conveyed the hereinafter-described real estate (the “Property”) to Barney B. Regen, Trustee (the “Trustee”), to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the Grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the “Note”); and

Beginning at a ½ inch diameter re-bar pin found on the East bank of a spring branch, and on the West side of the Clint Flowers Road, being the Northwest corner to the original property of which the herein described parcel is a part, said point being located North 12 degrees 52 minutes 22 seconds East 750.05 feet from a concrete monument found at the North right-of-way of Interstate No. 40 and East of State Route 230; thence runs South 78 degrees 00 minutes 00 seconds East, in all 250.00 feet crossing the Clint Flowers Road and running with Runions South boundary line, North 80 degrees 35 minutes 56 seconds East 353.70 feet to a ½ inch diameter re-bar pin with cap (stamped “RLS #69 & #1569”) set, said point being Runion’s Southeast corner, also being the Northeast corner to the herein described property; thence runs with Willamette Industries, Inc.’s West boundary line (an old marked and painted line), South 01 degree 42 minutes 27 seconds East 305.99 feet to a ½ inch diameter re-bar pin with cap (stamped “RLS #69 & #1569”) set in the North right-of-way of Interstate No. 40, said point being the Southeast corner to the herein described property; thence runs with the said right-of-way South 60 degrees 14 minutes 34 seconds West 295.26 feet to a ½ inch diameter re-bar pin with cap (stamped RLS #69 & #1569”) set; thence runs with a new line North 87 degrees 44 minutes 18 seconds West 292.71 feet to a ½ inch re-bar pin with cap (stamped “RLS #69 & #1569”) set, said point being the Southwest corner to the herein described property; thence runs with a new line North 06 degrees 43 minutes 33 seconds East 251.44 feet to a point, being an interior corner to the herein described property; thence runs with a new line, North 80 degrees 55 minutes 08 seconds West, passing a fence post reference point at 149.47 feet, in all 157.10 feet to a point in the center of the Clint Flowers Road; thence runs with the West boundary of the herein described property, North 24 degrees 07 minutes 30 seconds East 175.91 feet to the point of beginning, containing an area by computation of 5.07 acres, by survey of Thomas C. White & Associates, R.L.S. No. 69, dated February 14, 1996, Drawing No. 167-2296.

Also conveyed herewith is a permanent and non-exclusive easement for parking and for access and travel and for a waterline across a 2.7-acre tract, all as set forth in the deeds of record in Deed Book 85, Page 497, Deed Book 91, Page 595, Deed Book 96, Page 638, and Deed Book 101, Page 41, all in the Register’s Office of Hickman County, Tennessee.

Being the same property conveyed to Prakash G. Patel and wife, Varsha Patel, and Subhash T. Patel and wife, Rita S. Patel, by deed from Duck River Ranch, Inc. dated February 26, 1996, and of record in Deed Book 113, Page 198, Register’s Office for Hickman County, Tennessee.

This property is subject to all rights-of-way for all roads affecting the property with particular reference to Interstate 40 and Clint Flowers Road.

This conveyance in trust is subject to a reserved easement for the service and maintenance of a well across a 1.02-acre tract for the benefit of the herein described tract as set forth in the deed of record in Deed Book 92, Page 836, in the Register’s Office of Hickman County, Tennessee.

This conveyance in trust is subject to the following deed of trust for which the Holder of the note as stated below shall be responsible. That is, the Holder of the hereinmentioned note shall apply Grantors payments to it in such manner as to maintain current the payments on the following Deed of Trust:

(1) Deed of Trust executed by Dr. James T. Ralph and wife, Wei Ralph, to Lawrence E. Ramsey, Trustee, in the original principal amount of $381,747.00 to Ray S. Myatt, Jr. and Ray S. Myatt, Sr., dated August 19, 1991, and of record in Trust Deed Book 116, Page 905, in the Register’s Office of Hickman County, Tennessee.

Property is known as 5032 Tennessee 230, Only, Hickman County, Tennessee 37140.

Said sale will be in bar of the right and equity of redemption, homestead and dower, but subject to all tax and prior liens of record in the Register’s Office for Hickman County, Tennessee, which are applicable to this property and unpaid real estate taxes, if any.
