Plaintiff has filed a Motion for an Order allowing service of process upon defendants by publication in lieu of personal service. Plaintiff has demonstrated by affidavit that:

  1. Personal service of process on three (3) of the five (5) defendants cannot be made since the service of process was returned "not to be found in my city" as to the supposed Tennessee residents.
  2. Defendant, Lisa R. Dartis, was personally served on May 29th, 2018.
  3. Defendant, Jennifer Dartis Hayes, lives in California according to the signed Affidavit we received from her on June 28th, 2018 and refuses to be served.
  4. Defendant, William E. Dartis, was served by certified mail on September 22nd, 2018.
  5. Personal service of process on three (3) of the five (5) defendants, Christopher L. Dartis, Jennifer Dartis Hayes, and Jeffrey L. Dartis cannot be made since the service of process was returned "not to be found in my city" as to the supposed Tennessee Residents. Defendant, Lisa R. Dartis, was personally served on May 29th, 2018. Defendant, William E. Dartis, was served by certified mail on September 22nd, 2018.
  6. Certified mail was sent again to defendants, Christopher L. Dartis and Jeffrey L. Dartis, on September 12th, 2018; September 28th, 2018 we received the certified letter to Christopher L. Dartis back as unclaimed; and October 2nd, 2018 we received the certified letter to Jeffrey L. Dartis back as unclaimed.
  7. Despite repeated letters to the defendants, they have shown an unwillingness to cooperate and are evading service and refusing certified mail.

IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that:

  1. Forthwith cause a copy of this Order to be published, for four (4) consecutive weeks in the Hickman County Times, which newspaper is the newspaper of general circulation in the county.
  2. Defendants shall answer or otherwise respond to the complaint in this action within thirty (30) days of the fourth weekly publication of this Order, and if they do not answer or otherwise respond, a default judgement shall be entered against them.
