NOTICE OF SUBSTITUTE TRUSTEE'S SALE

WHEREAS, Marian E. Bailey, a married woman by Deed of Trust (the "Deed of Trust"), dated February 2, 2006 and of record in Deed Book 17, Page 8019, Register's Office of Hickman County, Tennessee, conveyed to American Home Title & Escrow, LLC, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the "Note") described in the Deed of Trust, which Note was payable to Mortgage Electronic Registration Systems, Inc. ("MERS") as nominee for Decision One Mortgage Company, LLC, as last transferred to THE BANK OF NEW YORK MELLON, F/K/A The Bank of New York as trustee for registered Holders of CWABS, Inc., Asset-Backed Certificates, Series 2006-BC4 by Assignment recorded in Book 28, Page 7716, Hickman County, Tennessee records, and

WHEREAS, default has been made in the payment of the Note; and

WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust. The notice requirements of T.C.A. §35-5-117 have been satisfied.

Beginning at a stake on the north side of Vernon and only road, said stake in the beginning corner of the Clint Nash Tract and stands 18 degrees West-2 poles from a black jack pointer in Nash Line, runs with the road South 83 East 12-1/2 poles to stake; thence north 6-1/2 East 36 poles to a stake at the old R.R. right-of-way, with Dogwood, Sycamore and Sugar Maple Pointers; thence North 42 West 6-1/2 poles to a stake with Elm Pointers, Nash's northeast corner; thence with Nash's East Boundary Line South 18 West 39-1/2 poles to the beginning, containing three acres, more or less.

Being the same property conveyed to Marian E. Bailey and husband, Elmis J. Bailey, as tenants by the entirety by deed from Richard Canady and wife, Shirley Canady, recorded in Book 17, Page 8017, in the Register's Office of Hickman County, Tennessee.

The street address of the above described property is believed to be 1206 Old Blue Ponds Road, Nunnelly, TN 37137, but if such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

NOTICE OF SALE OF REAL ESTATE

WHEREAS, by deed of trust dated February 10, 2017, of record in Book 36 at page 875 in the Register's Office of Hickman County, Tennessee (the "Deed of Trust"), Patsy C. Dunn (also known as Patsy L. Dunn) conveyed the hereinafter-described real estate (the "Property") to Barney B. Regen, Trustee (the "Trustee"), to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the "Note"); and

The street address of the Property is believed to be 2350 Highway 48 North, Nunnelly, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and the street address, the legal description will control.

The Property is believed to be identified as Map 071N-B-002.00 on the Hickman County tax map.

Permit Actions FILE # 19.233

The purpose of this notice is to advise the public of the following proposed permit action and solicit comments and information necessary to evaluate the potential impact of the proposed activities on the aquatic environment.

Pursuant to The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108 and Tennessee Rules, Chapter 0400-40-07, the proposed activity described below has been submitted for approval under an Aquatic Resource Alteration Permit and Section 401 Water Quality Certification. Section 401 of the Clean Water Act requires that an applicant obtain a water quality certification from the state when a federal permit is required. This notice is intended to inform interested parties of this permit application and draft permit and rationale, and to ask for comments and information necessary to determine possible impacts to water quality. At the conclusion of the public notice period a final determination will be made whether to issue or deny the permit.

PROJECT DESCRIPTION / PURPOSE

The proposed work includes stabilization of approximately 700 feet of Garner Creek stream bank using half-bank riprap revetment with half-bank plantings and placement of seven 15-foot in stream rock jetties. The rock riprap shall have a D50 of 15 inches in diameter, and range in size from 3 to 27 inches in diameter. The jetty structures will be spaced 75 feet apart in the downstream section and 150 feet in the upstream section. Rock used for the jetties shall be TDOT Class C riprap and range from five to 36 inches with a D50 of 22.6 inches. The partial bank riprap will extend to the top of the bank in the jetty sections. A minimum of a 35-foot wide native riparian buffer will be planted at a 6:1 ratio along the owned stream bank for the length of the applicant's property boundary, including the treatment area, and protective signage will be placed every 100 feet along outer edge of the buffer corridor.

ANTIDEGRADATION

The affected waters have available parameters for habitat. As described in the accompanying permit rationale, the Department has made a preliminary determination that the proposed activity will result in de minimis degradation.

FACTORS CONSIDERED

In deciding whether to issue or deny this permit, the Division will consider all comments of record and the requirements of applicable federal and state laws. The division will consider the nature, scale and effects of proposed impacts. The Division will consider practicable alternatives to the alteration, loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impacts to unique, high quality, or impaired waters.

HOW TO COMMENT

TDEC is requesting public comment on this proposed permit action. Obtaining a broad range of facts and opinions on Agency actions is one of the best ways to ensure appropriate decisions. Persons wishing to comment on the proposal are invited to submit written comments to the Division. Written comments must be received within thirty days following distribution of the approved public notice materials (including signage and newspaper ad). Comments will become part of the record and will be considered in the final decision. The applicant's name and permit number should be referenced. Send all written comments to the Division's address listed below to the attention of the permit coordinator, You may also comment via email to water.permits@tn.gov.

After the Division makes a final permit determination, a permit appeal may be filed by the applicant or by any person who participated in the public comment period whose appeal is based on comments given to the Division in writing during the public comment period or in testimony at a formal public hearing. When there is sufficient public interest in water quality issues, the Division will hold a public hearing in accordance with 0400-40-07-04(4) (f). Send all public hearing requests to the attention of the permit coordinator at the address listed below or via email to water.permits@tn.gov. Any scheduled public hearings will be advertised through a similar public notice process.
