NOTICE OF SALE OF REAL ESTATE
WHEREAS, by deed of trust dated February 10, 2017, of record in Book 36 at page 875 in the Register's Office of Hickman County, Tennessee (the "Deed of Trust"), Patsy C. Dunn (also known as Patsy L. Dunn) conveyed the hereinafter-described real estate (the "Property") to Barney B. Regen, Trustee (the "Trustee"), to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the "Note"); and
WHEREAS, by warranty deed dated October 4, 2018, of record in Book 39 at page 272 in the Register's Office of Hickman County, Tennessee, Patsy C. Dunn conveyed the Property to Karen Love; and
WHEREAS, default has occurred in the payment of the Note and other provisions of the Deed of Trust have been violated, and First Federal Bank, the owner and holder of the Note, has declared the entire indebtedness due and payable, and has directed the Trustee to foreclose the Deed of Trust in accordance with the terms thereof;
THE PUBLIC IS HEREBY NOTIFIED that the Trustee will sell the Property at public auction to the highest and best bidder for cash at the south door of the Historic Hickman County Courthouse on the Public Square in Centerville, Tennessee, at the hour of 10:30 a.m. prevailing central time on Friday, May 1, 2020, in bar of Karen Love's right and equity of redemption, and subject, inter alia, to all liens, encumbrances, and other defects in title having priority or preference over the Deed of Trust; to the rights of tenants in possession, if any; and to all applicable and enforceable laws of governmental authorities having jurisdiction of the Property, whether or not such matters are disclosed by the public records of the county wherein the Property is located.
The Property is described in the Deed of Trust as follows:
Lying and being situated in the First Civil District of Hickman County, Tennessee, and being more particularly bounded and described as shown on the Tax Books as Map 071-N, Group B, Parcel 002.00.
Beginning at a set stone on the East side of the right-of-way of State Highway #48, it being Adam and Reba Cline's Northwest corner and runs thence in an Easterly direction with Cline's line about 160 feet to a set stone in Cline's North boundary line; thence in a Northerly direction and parallel with the right-of-way of State Highway #48, 100 feet to a set concrete highway marker; thence in a Westerly direction and parallel with the first line above mentioned, about 160 feet to a set stone in the edge of the right-of-way of Highway 48, Mrs. Lon Loveless's Southwest corner; thence in a Southerly direction with the right-of-way of #48 Highway 100 feet to the beginning.
Being the same property conveyed to Charlie Lee Coleman and wife, Myrtle May Coleman, by deed from Terry M. Chandler and wife, Cornelia H. Chandler, dated August 10, 1979, and recorded August 14, 1979 at 11:05 a.m. in Deed Book 50, page 8, Register's Office, Hickman County, Tennessee, and passing to Patsy C. Dunn as the only child and heir-at-law of Charlie Lee Coleman and wife, Myrtle May Coleman.
The street address of the Property is believed to be 2350 Highway 48 North, Nunnelly, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and the street address, the legal description will control.
The Property is believed to be identified as Map 071N-B-002.00 on the Hickman County tax map.
The Property is believed to be improved.
The right is reserved to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the sale above; to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the adjourned sale; and to repeat this process from time to time until the Property is sold by the Trustee, or until the expiration of one (1) year following the originally scheduled date of sale, whichever occurs first.
The right is reserved to cancel the sale of the Property at the request of the secured creditor, and to re-advertise the Property for sale at a later date, without diminishing, impairing, or otherwise affecting the priority of the Deed of Trust as a lien on the Property.
If the highest bidder does not pay the bid price within twenty-four (24) hours of the sale, the right is reserved to sell the Property to the next highest bidder who is ready, willing, and able to purchase the Property for cash.
The record owner of the property is Karen Love .
There is no record holder of any mortgage, deed of trust, or other lien which will be extinguished or adversely affected by the sale of the Property, and which mortgage, deed of trust, or lien, or notice or evidence thereof, was recorded in the public records of Hickman County, Tennessee, more than ten (10) days prior to the first advertisement or notice of sale, except the United States of America.
The Trustee is unaware of any other party whose rights will be adversely affected by the sale of the Property pursuant to this notice.
The Property is subject to the lien of the United States described in a notice of record in Book 32 at page 938 in the Register's Office of Hickman County, Tennessee. The notice required to be given to the United States by the provisions of 26 U.S.C. § 7425(b) has been given in the manner and within the time prescribed by law. The sale will be subject to the right of the United States to redeem the Property, as provided by 26 U.S.C. § 7425(d)(1).
The Trustee is considered a debt collector within the meaning of the Fair Debt Collection Practices Act. Accordingly, this notice is from a debt collector attempting to collect a debt and any information obtained will be used for that purpose.
